Dynaroot Asia is operated by BIOSPHERE SOLUTIONS JV CO., LTD. (Thai Company Registration No. 0315567002570), a company organised and existing under the laws of Thailand, with its registered office at 112 Moo 9, Nong Yai Phim Subdistrict, Nang Rong District, Buriram Province 31110, Thailand (hereinafter referred to as "Dynaroot Asia", "we", "us" or "our").

GENERAL

  1. You acknowledge and confirm that you are at least 18 years old to use the services provided on the Dynaroot Asia website.
  2. Dynaroot Asia reserves the right to modify or remove any part of dynaroot.asia at any time without prior notice.
  3. By placing an order, you agree that all information provided to Dynaroot Asia for the purpose of purchasing goods or services is accurate, that the credit or debit card used belongs to you, and that you have sufficient funds to cover the cost of the items ordered.
  4. Due to the nature of the internet, there may be interruptions to services or website availability due to maintenance, repairs, or the introduction of new services. We will make every effort to minimise downtime.
  5. The contents of dynaroot.asia may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without our express written permission.
  6. Any complaints related to orders or products must be accompanied by clear and sufficient photographic evidence. Dynaroot Asia reserves the right to refuse compensation if the necessary information is not provided.

PURCHASING

  1. Once you have completed your online order, you will receive an automated email confirmation. Please note that this email confirmation does not guarantee that we can fulfil your order; it simply confirms that we have received your order and are processing it.
  2. Your credit or debit card will not be charged until the items have been shipped.
  3. If you are a consumer purchasing within the Kingdom of Thailand, you are entitled to the protections afforded by the Consumer Protection Act B.E. 2522 (1979) and any subsequent amendments, including the right to refund or replacement for defective, damaged, or non-conforming products.
  4. Before placing your order, you must agree to these Terms of Service. A direct link to these Terms of Service will be provided at checkout.
  5. Each order is treated individually and will be processed accordingly.
  6. Any defective, damaged, or incorrect orders shipped must be reported to Dynaroot Asia within 7 days of receiving your order. We will replace or refund your order according to these Terms of Service.
  7. All products and services are subject to availability. Dynaroot Asia strives to maintain accurate stock levels; however, if an item is out of stock, it will be removed from your order or replaced with a similar product. If the item you ordered is still required and a suitable replacement cannot be found, we will keep your order until the item is back in stock.
  8. Dynaroot Asia cannot control or take responsibility for the actions of Customs and Excise authorities. All packaging is discreet, with no indication of the contents displayed externally. However, if the items you have ordered do not comply with the laws of the destination country or region, there is a risk that customs authorities may interfere with your package. In such a situation, Dynaroot Asia cannot offer any assistance. We only ship products to jurisdictions where the importation of agricultural inputs and plant cultivation supplies is legal, and we advise you to educate yourself about the laws applicable in your country. By placing an order, you accept full responsibility for complying with the regulations in your individual country. We cannot refund any payment for orders placed from countries where the imported product is prohibited.

PRICING & PAYMENT

  1. All prices shown on the Dynaroot Asia website are final and include VAT unless stated otherwise. In the case of pricing errors, your order will be put on hold until Dynaroot Asia contacts you using the provided methods.
  2. Customers are responsible for paying any Import Duty / Tax in their respective countries, where applicable. Contact your local customs authority for more information on this.
  3. Full payment must be received before any goods are shipped. All products are subject to availability and remain the property of Dynaroot Asia until paid for in full.
  4. Dynaroot Asia does not share any personal or financial information with third parties beyond what is described in our Privacy Policy.
  5. All credit/debit card details are encrypted using a secure ordering system. Your bank or credit card company may require security checks to validate your purchase.
  6. For orders of a significant nature or where insufficient details have been provided, Dynaroot Asia may require credit checks or additional verification. This could result in a delay in your order until the checks can be completed.

RETURNS

  1. Please note that all returns for damaged or faulty goods must be confirmed by Dynaroot Asia via phone, post, or email before the goods are returned.
  2. All returns are the customer's responsibility until they are received by Dynaroot Asia.
  3. The cost of postage for returning the product will not be refunded, except in cases where the return is due to our error (e.g., wrong item shipped or product defective on arrival).

LIABILITY

  1. The liability of Dynaroot Asia for defective products will be limited to direct damages up to the price of the products concerned. Liability for indirect, consequential, incidental, or punitive damages is expressly excluded to the maximum extent permitted by applicable law.
  2. By using our Services, you agree to indemnify and hold harmless Dynaroot Asia, BIOSPHERE SOLUTIONS JV CO., LTD., its subsidiaries, affiliates, directors, agents, and any other party involved in creating, producing, or delivering the Website or Services against any and all claims of third parties arising out of your use of the Services and/or your violation of these Terms of Service.

GOVERNING LAW & DISPUTE RESOLUTION

  1. These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict-of-laws principles.
  2. Any dispute, controversy, or claim arising out of or in connection with these Terms of Service, or the breach, termination, or invalidity thereof, shall be settled by arbitration administered by the Thailand Arbitration Center (THAC) in accordance with its rules in force at the time of the application for arbitration. The seat of arbitration shall be Bangkok, Thailand. The language of the arbitration shall be English.
  3. Notwithstanding the above, Dynaroot Asia retains the right to bring proceedings in any court of competent jurisdiction in Thailand for the purpose of recovering unpaid amounts or seeking injunctive relief.

CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms of Service at any time without prior notice. The most current version will always be available on dynaroot.asia. Continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
